What is a trademark?
Under Section 2(zb) of the Trade Marks Act, 1999[1], a trademark is a mark capable of being represented graphically and distinguishing the goods or services of one entity from another.
A trademark may include brand names, logos, taglines, symbols, colours and combinations, shapes of goods or packaging, sound marks and smell marks. Trademark protection ensures that your brand identity remains distinct and legally enforceable.
Who can apply for trademark registration?
Any person or legal entity claiming to be the proprietor of a trademark (used or proposed to be used) can apply[2]. This includes individuals, proprietorships, partnership firms, LLPs, Companies, startups, MSMEs, trusts and societies and government bodies. The key requirement is that the mark must be distinctive and capable of distinguishing goods or services.
What is distinctiveness of trademarks?[3]
For a trademark to be registered, it must be unique and non-generic[4]. It should not be deceptively similar to existing marks. Descriptive marks may be registered only if they acquire distinctiveness through long term use.
Documents Required For Trademark Registration
To file a trademark application in India, the following documents are typically required representation of the mark (logo or word mark), Form TM-48 (Power of Attorney, if filed through an attorney), User Affidavit (only if prior use is claimed), supporting documents showing use (invoices, ads, etc.), MSME/Udyam Certificate (if applicable for fee concession) and Start Up Certificate (if you are eligible for one).
Trademark Registration Process In India[5]
1. Trademark Search
A trademark search is conducted to identify existing identical or similar marks.
This helps in assessing chances of registration, avoiding objections and opposition and reducing legal risks.
2. Filing of Trademark Application
The application is filed using Form TM-A with the Trademark Registry. Once filed an acknowledgement is issued and the applicant can use the ™ symbol.
3. Examination by Trademark Registry
The application is examined under the Trade Marks Act and Rules. The Registry may accept the application, or issue an examination report with objections. The applicant must respond within the prescribed timeline (typically 30 days).
4. Publication in Trademark Journal
If accepted, the mark is published in the Trademark Journal. Third parties can file opposition within 4 months and, opposition proceedings may follow if challenged.
5. Registration of Trademark
If no opposition is filed (or resolved in your favour), the trademark is registered, a registration certificate is issued, and the ® symbol can be used.
6. Renewal of Trademark
A trademark registration is valid for 10 years and is renewable indefinitely. Renewal can be filed before expiry. Failure to renew may result in removal from the register.
